Menever any works are to be executed under the direction

(1) Whenever any works are to be executed under the direction of
the Port Trust, the Port Trust shall call for tenders by publi.
advertisement for the execution of such works except in cases
(a) of pressing emergency in which delay would be injurious to
the public interests; or
(b) in which from the nature of the work it can be more
expeditiously or economically executed by the officers and
servants of the Port Trust or of a Government department; or
(c) where the estimated cost of the work is less than 5,000
dollars.
(2) Contracts for the supply of material or labour or otherwise for
the execution of the works shall be executed on behalf of the Port
Trust in the following manner.
(a) if the total amount of money to be expended under the
contract exceeds 5,000 dollars the contract shall be
executed by the affixing of the common seal of the Port
Trust.
(b) If the total amount of money to be expended under the con-
tract is not more than 5,000 dollars the contract may be
executed by the Chairman affixing his signature thereto in
the presence of a witness.
Subject to the provisions of sub-section 7 (3) no new work shall be
undertaken or any portion thereof put in hand unless the plans and
estimates thereof are first approved.
(a) if the amount to be expended exceeds 5,000 dollars; by the
Port commissioners
(b) if the amount to be expended on the complete work exceeds
200000 dollars; by the Governor in Council.
(1) The Port Trust may make by-laws not inconsistent with the
provisions of this Ordinance for the direction and condutt of the
Port Trust and its employees, and the administration, management and
control of the several harbours, works and property under its juris diction including:
(a) the regulation and control of each and every matter in
connection with vessels and aircraft navigating the harbours and their mooring, berthing, discharging or loading or any-
thing incidental thereto;
